The Eric Echols Case: You Cannot Make Up This Stuff

If I were to have written a movie script about the Tonya Craft case, and added the contrived charges against Eric Echols, add in the "Mommie, Dearest" assault on Mr. Echols by Sandra Lamb, and throw in Buzz Franklin's attack on the jury after it rightfully acquitted Ms. Craft, I would have been laughed out of every producer's office. "No one," they would have told me, can engage in conduct THIS ridiculous.

No judge, the producers would claim, would use, "He's on cross" as a reason to shoot down defense objections, nor would anyone believe me if I had in the script something about a prosecutor screaming about "boobs" while cross-examining a defense witness. Throw in a judge who is reprimanded (and then we find she has failed to pay her dues to the Georgia State Bar for several years) along with witnesses who cannot even commit perjury with a straight face, and you have the makings of something from Alice-in-Wonderland.

Yet, what I have described -- and more -- seems to be the norm for the Lookout Mountain Judicial Circuit, and just when it could not get any more bizarre, well, it gets more bizarre. If the fact that prosecutor Chris Arnt actually believed he could manufacture a criminal case against Ms. Craft's private investigator, Eric Echols, is not strange in itself (demonstrating that Arnt believed he could make up the law as he went along), the fact that all four judges of the LMJC recused themselves from the Echols case ups the ante.

What makes this latest judicial caper so strange is that none of the judges gave a reason as to why they would refuse to hear this case. They just said they won't do it, throwing the whole thing into turmoil. Actually, there does not need to be turmoil, as what Franklin's office needs to do is to drop the charges ASAP.

(If the prosecutors of the LMJC were humiliated by the jury's acquittal of Ms. Craft, imagine what would be the case when the word gets out that the LMJC is bringing false charges against an African-American who clearly committed no crimes. Should they think Tonya's case put them under a microscope, continuing to pursue the charges against Mr. Echols would leave them with no cover at all, a prospect, frankly, that warms my heart.)

With Channel 3 (bless Melydia Clewell and Callie Starns) having dropped its latest bomb, a transcript of Mr. Echols' conversation with Jerry McDonald, the father of Child Accuser #2, more and more people are going to realize that Arnt had Mr. Echols arrested ONLY to keep him from doing any more investigations. Call it what you want, folks, but it smells like obstruction of justice to me.

No, even Lewis Carroll could not have come up with characters like Len "The Man" Gregor, "Facebook" Arnt, and "judge" Brian House, and he could not have imagined a script as weird as what has been the LMJC Show for the past few years. Furthermore, we are not even at the end of this farce, as I believe this while this cheap suit of a judicial district is going to unravel in real time.

Sit back and enjoy the show. Arnt, House, Gregor, "judge" Kristina Cook Graham, and "Buzzare" Franklin have enjoyed their 15 minutes of fame, but now that fame is going to turn into unwanted notoriety, and there is no place for any of them to hide. Eric Echols is not going to be put on trial, is not going to be convicted, and is not going to jail.

I only wish that the real criminals that populate the offices of the LMJC could find themselves taking permanent residence in the Crowbar Motel. However, even as weird and unpredictable as this bad show has been these past few months, I doubt that such a happy ending can be written into the script, even if justice demands it.

How can the charges stand if all four judges have recused the case and won't hear it? What happens next? Do they bring in another judge from elsewhere or are they forced to drop charges???

It means they want hear the case or any motions. They didn't give a reason, they just recused themselves. Which means for the DA if they want to proceed with the charges they have to call for a judge from another district to hear the case.

Here is why I have absolutely no faith in the Georgia Attorney General's Office doing the right thing in the cases of Tonya Craft, Eric Echols, Brad Wade, or any other case:

Open that wikipedia article, hit control-F, and type in Baker. Every time you see the word "Baker" hilighted in yellow, you'll read about an attorney general acting to usurp justice: In a nutshell, 17 year old engages in consentual oral sex with 15 year old, supid loophole in Georgia law makes oral sex a manditory 10 year sentence, kid appeals, wins appeal, Baker does his damnedest to keep kid in prison for full 10 years despite overwhelming outcry for kid's release, it took Georgia Supreme Court to release the kid after 2 years in prison--he'd have spent less than half that had he actually had intercourse with her instead of oral sex.

On May 24, 2007 former US president Jimmy Carter wrote a letter to state attorney-general Thurbert Baker (who is also African-American) in which he questioned whether Wilson's race had played a role in his treatment. He wrote: "The racial dimension of the case is likewise hard to ignore and perhaps unfortunately has had an impact on the final outcome of the case," pointing out that white defendants have received lesser punishments for similar conduct.

Guys, don't count on Baker or Perdue doing the right things in these cases. They're out to show they're "tough on crime" to get more votes. If you want justice, you're going to have to get people into government who aren't out to "uphold the law," but who are out to "uphold justice."

As I understand it Echols stayed in Chatt in a motel, and is maybe where some meetings took place.
I just keep remembering Gregor in court making the comment that Tonya met him in the motel that also had a BED?! gasp...
Did Jerry M also come there to see him where this ame BED is?!

I have believed all along that House got "stuck" with Tonya's trial because he was the "lowest man on the totem pole". This due to the fact that he had not been a judge very long, less than three years if I'm not mistaken. Thrown under the bus, as it were. He wasn't smart enough to recuse himself then and it's a joke that he does so now.

All of this is really sad. It is becoming more apparent that there will be nothing done about the crap that they do down there. I went to the town to support Tonya during her trial and i will never go back. I could be thrown in jail because of the color of my skin. I was the only black person in the courthouse that day lol.

Bill, another good article and like you I can't wait to see how this turns out. If the DA had a brain at all, he would drop the charges now, but we both know he is just too blasted arrogant to do so.

I'm afraid I have to agree with Trish but not her reasons. The DA is backed into a corner and reacting like any animal in the same situation. He's lashing out and his attempts to 'educate' the general populace are bring more shame to LMJC. Does Buzz really believe no one in this area looks on the internet to check out these statements of his? Is he that much of a fool?
Strke the last question. Of course he's a fool. Otherwise, he'd go back into hiding and take on his simple burglary cases and let the overwhelming number of molestation cases drop for those railroaded by his prosecutors trying to make names for themselves.
It was mentioned on this blog (maybe) or maybe in one of the many news stories during Tonya's trial that Len Gregor plans to run for Buzz's position in the next election. Has anyone heard more on that issue? Does 'the man' (small case deliberate) really believe anyone will vote for him after this?

Lame, I remember the case you're referring to and thought at the time it was bogus. How can anyone even think about ruining a teen's life because he and a girl had consensual sex? Are those prosecutors going to go after all us adults who did the same thing at the same age? Come on. This whole molestation thing is getting out of control. Teens will have sex. That's a given, especially in an area where it's shouted at each and every pulpit as being the root of all evil. Those people are making sex forbidden fruit, and as we all know, teens dive into forbidden fruit to find out what it's all about. Unfortunately, that teen still has to live with the stigma of his actions, even though the girl involved claimed it was consensual, because GA law keeps his criminal record around. More reason to avoid our esteemed AG as the next governor. The problem will only get worse. Law and order as a platform for political office yes. But not law and order as it's currently defined in this state.

Honestly, Buzz Franklin reminds me of Rod Blagojevich. They both want to be seen and both desperately need attention. They don't care if the attention is negative/bad so long as they get noticed.

Correct me if I am wrong, but isn't NBC Dateline in LMJC counties *RIGHT* now doing background for an upcoming piece on the Tonya Craft case?

If so, how can the DA's office be so blind to the likely production of an NBC Dateline episode entitled: In the Heat of the Night: The Eric Echols Case?

Whether you like the bias or not (or that the narrative is truthy instead of truthful), the New York production crew of Dateline has just got to love the sweeps week appeal of the following narrative:

Eric Echols is a dedicated black professional who was working to help and innocent white women. Little did he know when he left Atlanta for the racist, NW corner of Georgia he would be assaulted, arrested, and put on trial on trumped up charges
Stay tuned for a story of racism on how little some things have changed in the rural South.


Even if DA Franklin drops the Echols case this afternoon. Nightline has still got a winner episode for sweeps week.

How can any elected official be that tone deaf to the drubbing Nightline is going to give him over this?

My gawd I watched the linked story @ Channel 3 and it just boggles the mind.

I suppose the fact they've gotten by with this nonsense for so long has made them more than slightly arrogant. They seem to believe they can do whatever they wish and won't be answerable to anyone. I am truly shocked at the arrest of Echols and Mr. Anderson, yes it seems it is obstruction.

If that is true (and I think it is), these two shows from NBC Dateline (Craft and Echols), will show Buzz Franklin what happens when the media really is *AGAINST* him rather than simply asking reasonable questions as Channel 3 and KGOW were doing.

That is going to produce some ugly YouTube moments for him and his crew.

Is it still schadenfreude when the misfortune is deserved?

I'm certainly open to being corrected here, but I do not believe the prosecutor, alone, can drop the charges. The charges are an open case in the state's records now, and I think closing it requires a judge.

It's a given that the judges are in close communication with the DA's office daily, so I then question what the plan is that left the DA without a judge to close the case? The DA's office was aware that the judges were all recusing themselves.

Having never seen this problem of no judges being available for a pending case before, I'm not even sure how the prosecutor or defense could get a judge from another circuit involved. I have a suspicion that the problem lies in the lap of Echols and his attorney, as an open case against him is just sitting there on the records and NOBODY is available to respond to anything they file with that judicial circuit.

I suppose the simplest method would be for whatever judge that had the case - presuming there was a judge on it because someone had approved changing the trial date - just enter for the record that it is closed, but the all judges evidently recorded that single sentence filing that excused them all from hearing the case.

Back to the DA's office running for cover here; They seem to be tossing all the standard excuses at the wall to get something to stick, the multiple choice CYA! No judges, cost overruns, sheriff acting like they had not seen the interview transcripts (like it's new evidence!), witnesses dropping out...

Even by drooping the case, somehow, it reads like PROOF they had made the arrest to withhold justice from Tonya, like we didn't ALREADY KNOW THAT!

The DA's office is still left with the problem of Echols complaint about Saundra Lamb. If Echols continues with the complaint, and the DA ignores it, then the DA's office adds the need for an explanation in its practice of selective enforcement of the laws.

The web just keeps growing more tangled, as the reckless disregard grows more obvious (Though it is apparent to us, it is near impossible to show intent of the prosecutors here). Echols is looking more like a candidate to become a plaintiff in a civil complaint.

I one of those that flys under the radar. The person that bends into the background. I hear things and see things. Buzz is frozen with indecision right now. He is afraid to move forward on some cases. One case is clearly a prosecutable case but because the person is a bully he is scaried to do anything. This person regularly belittes him, his office and all of the law enforcement in the area on several blogs.

I read the transcript and I both felt sorry for and angry at Jerry. Sheesh what a cowardly weakling! Its obvious that he was mentally lazy about the whole thing. He just wanted someone else to take care of it without him making any effort to find the right path. He left it to his wife, the prosecution, and his daughter to handle it. He thought that was protecting his family. Protecting one's family is a priority, but what if (as was constantly pointed out to him) an innocent person that he claimed to care about is being railroaded and has herself lost her own family in the process. He talked about being too busy to figure out what to do or even what the facts were and what his rights were, but he had time to take family activities and have conversations at work. Worst, Echols laid it out very clearly and very prophetically that Tonya could be acquitted and then sue in civil court. Also that the "physical evidence" by their personal physician pointed to innocence, that the tactics used by the police to interrogate the daughter were coercive and intimidating, and that prior cases outlined in the movie Witchhunt showed how communities could be caught up in a hysteria of false allegations. Jerry did nothing honorable because he pitied himself as the victim and was waiting for someone else to do the right thing. He erroneously thought that standing by your family was to believe his daughter without adequately probing the situation and analyzing the methods. So, unwittingly he actually contributed to his own daughters grief and exploitation - the very thing he claimed he wished to avoid. Echols even pointed out that the 4th family took staunch position in both refusing to participate in the accusations and to even bring their daughter to submit to an assesment. Echols also revealed to Jerry that his daughter had been assigned a disreputable "therapist" in Evans and that his own daughter had some questionable sexual contact with a cousin prior to the alleged molestation by Tonya. A reasonable person would have taken a few days off work and followed up by talking to a lawyer, taking their daughter to a real professional, asking around for more evidence instead of just claiming it had nothing to do with him and wishing it would just go away.

I had just noticed in the previous comment thread that john lichtenstein had wrote to me; "I am sure dad #2 is not wrong."

To clarify myself, in my stating Jerry might have been wrong about what their personal doctor had reported to them, I was considering the possibility that the doctor had not done as complete of an examination as Sharon Anderson had.

I'd anticipate that the examination by their doctor was much less intrusive as that performed by a SANE, a process which can victimize a child in itself from all I've read about it and a few that conduct those exams.

Though I must assume such, I have absolutely no doubt that the defense team was aware of the exam by their doctor, had obtained all reports available of that exam in discovery, and given careful consideration to the value of it if they decided not to bring it up in trial.

If they wanted it introduced, for whatever value it might have held as evidence, they'd have most likely needed to call in the doctor that prepared any report and conducted the exam to get it in the records for the jury to consider.

I see value in it, but am uncertain how it can be weighed against a SANE exam which could have been a bit more in depth, though it was conducted by one lacking in the skills and knowledge necessary.

Kerwyn is one that could be of great help on this topic! I'd sure like her input here, as my opinion is certainly open to the expertise of knowledge she holds in this area.

So, the judges have recused themselves and Melydia Clewell stated that the witness refuses to work with the prosecution and will not testify against Mr. Echols. What's left? Do/can they leave the charge against him just sitting there in order to hurt him? This has to be settled in some way doesn't it?

For me here this case has yet another crossroads.
If you truly believe ALL the claims against Tonya are false, the Jerry & Kelli McDonald has a right to join Tonya in the civil lawsuit and collect from the same ones for manipulating their daughter and ruining their family.
Now if Jerry sticks with what he testified to in court, then he has some serious explaining to do about the false statements.
Jerry & Kelli now have some REAL serious decisions to make. If they were totally FORCED to do this, it's time for them to speak up and tell what happened.
If Buzz actually done what was disclosed in this transcript, the Mr. Anderson is TOTALLY right with his suggestions for disbarment.

I may be wrong, but if a father & mother do not believe something not want ANYTHING to do with the prosecution under any circumstance, then it's bad wrong to allow the manipulators at the CAC to talk to the kids. I want to see the videos or read the transcripts of the interviews with the kids.
We already know these interviews were skewed to make the facts match the claims from Sandra Lamb, so how can any of it be credible?

In reading the transcript, Jerry was told by (I am assuming) the CAC not to talk to anyone on the defense side or to talk to their own daughter unless she herself brought it up. How can the CAC be in any position to tell the parents they cannot talk to anyone? They are not legal advisors.

He gave no real reason why he couldn't speak to a lawyer other than he didn't have the time or money. Seemed he just wanted to bury his head and hope that everything would just go away. Sad.

I'm not aware of anything that says they can't. Maybe the statute of limitations.

It seems to me that the burden created by all judges ignoring the case is then Echols to resolve it somehow.

Also, I wonder if Mr. McDonald is helping in the suit Ms. Craft has filed and that is why he and his wife are not named. SO MANY QUESTIONS! LOL@myself

If I were the Lambs, Wilsons or Boyds, I'd take a good long vacation to Aruba, Hawaii, or Seychelles, somewhere exotic and expensive, use as much of my money as I can while I still have it, because pretty soon all of my money is going to Tonya Craft.

Echols does not have a lawsuit that I know of. He filed a complaint for a crime committed against him by Saundra Lamb.

I suppose you can file a suit against anybody, but if Echols has a suit planned, I'd guess it to be against those who arrested him and continued with the charges. He probably could not get a great deal for only being slapped by Lamb.

The one that filed to have him charged had to have had some type of complaint or evidence of a crime supplied from somebody. If Echols would have grounds for a claim against the authorities that arrested him, my guess is that it would have to show the basis for his arrest was clearly not sufficient or it was fabricated.

Usually there is some type of affidavit or a citizens complaint filed to obtain an arrest warrant, but I'm not certain if one exists in this case.

kbp, thank you! It is so easy to get confused at this point. I'm wondering if files are missing or misplaced now. There is so much here to try to comprehend.

I sincerely hope that Angie's brother, Brad Wade, is being helped by all of this. It will make me sick if this hinders him.

Tonya's lawsuit is filed in a Federal court, so NO, the trial will not be in the LMJC.

According to Melydia Clewell, on WRCB at 6 tonight they will compare witness statements to tapes made by PI Eric Echols in Tonya Craft case. "You decide which version to believe."

This just gets better and better!
I am so thankful for Callie Starnes, Melydia Clewell, Channel 3, and the others that have stayed with this case.

i have not read the transcripts from echols, but it has been my understanding since long before the trial ever began that jerry mcdonald contacted the DA's office and said he did not believe these children were abused by tonya and he wanted out. it is also my understanding that kelli's brother is the one who told them to get out.
arnt then threatened jerry by saying he would not back out if he knew what was good for him.

jerry's testimony on the stand made me want to throw up. "...i know it dee-id, da-eddy." he is a liar. he lied under oath. he joined forces to convict an innocent woman and he deserves to be prosecuted and rot in hell with the rest of those hillbilly bastards.

jerry may have been manipulated by his wife and her evil friends, and he may have been threatened by chris arnt... but he is ultimately responsible for his own actions. he went through with his role in the master plan and he deserves to be punished.

I personally don't think the case against Mr. Echols. I suspect that the prosecution team was so intent on framing Tonya Craft that it didn't matter who her PI was. Still I'll take it. For no other reason then it's fun watching Arnt and Gregor squirm under a microscope. Huge, huge mistake attacking the media and jury members over a lost case.

So, it turns out that not only Jerry McDonald lodged a complaint, but Sandra Lamb as well. I assume then that the 3 counts were for the one time that Echols encountered Lamb and then the 2 interviews with McDonald.

Buzzie is still dodging the questions from Channel 3, but apparently, if neither witness is wanting to participate, and that's all the DA had to start with, then that should be the end of it. Franklin needs man up and drop the charges against Echols and instead charge Lamb and McDonald with false statements to law enforcement.

What we are absent here is the date that the DA's office has the records from Echols recording made available to them.

The prosecution may still have buried themselves by ignoring what Echols gave them until after Tonya's trial.

Should the alleged stories told by the witnesses, which the prosecution says they based the arrest on, not match what ALL of the witnesses say now, that could be a problem. I suspect the complaints were signed, those witnesses may be stuck with their original stories.

The lies just keep growing.

I think that Ms. Craft is a force to be reckoned with.

She is a particularly strong, intelligent, and persevering woman.

It is so sad that justice in this country is often hijacked by people like the local courts and by CPS (beware--do not ever, ever, ever involve CPS in your lives).

Kudos to Ms. Craft.

My thoughts and prayers are with her in realizing a reunion with her children.

Yes, and the complaints by Lamb and McDonald don't exactly seem to square with the truth. So, besides committing assault (with racial bias) and perjury, Lamb also commits the crime of filing a false report.

McDonald only has perjury and filing a false report on his rap sheet. These people are something. We have seen a virtual crime wave in Catoosa County, except that the crimes are being committed by the hand-picked lackeys of the prosecution.

I guess that if one wishes to live a life of crime, Catoosa County is the place to go. As long as you are friends with the prosecutors and the police, you are free to be a felon.

I saw the clip from tonight's story (Thank you, Anon 9:18 for the link) and read the transcript of Mr. Echols' interview with Jerry McDonald.

I used to feel sorry for Jerry McDonald, because I thought he was a good man but just a bit of a pushover.

I now think he is just a spineless man who can neither protect his family nor stand up for himself. He lies as he goes along just so he can get the hell out of his "immediate" trouble. HE IS EXACTLY LIKE A CHILD THAT WAY!!! No consistency in what he is saying at one moment to another!!!!!

If someone tells me that his complaints about Mr. Echols "harrassing" him by showing up at his doorstep or at his work was manufactured by Buzz's office, then I will change my mind about him.

From what I hear they recused because the feds are circling. Less on record the better. Judges may have immunity but they can be deposed which would open them to questions regarding... conspiracy etc.

Perjury is not often pursued. If it were persued then many, many cases involving CPS and its perjuries would have come to court.

There are many levels here, legally.

After reading the transcript of the interview of Jerry McDonald and watching the video re Echols. One has to wonder why McDonald filed against Echols? Based upon his interview the man doesn't seem to have a backbone to make a decision to file the report. If I am right about his lack of ability to do so then who put McDonald up to filing the report? Who was behind it?

Gossip Girl you are right on!!! You said what I said in the last thread, but I'm a few days behind. LOL I have never felt sorry for Jerry McDonald. As you said, he is ultimately responsible for his own decisions. Just because he's weak, doesn't mean people should have pity on him. He is a grown man & should act as if. He apparently had no problem producing 4 children. Also, the excuse of no time or money, B.S. Jerry, you have vacation days & I know this & you also make damn good money. Sorry if Kelli has to buy her clothes from the tent & awning store & it's more expensive, but give her a food allowance. If you would have gone to the GBI, it wouldn't have cost you a dime.

Lame, the case you are referring to was also sickening and ridiculous. I will explain the proper use of the oral copulation law. It is a very, very old law on the books. It's initial intention was simply because it was thought to be dirty and wrong. But, in later years, it's use can actually benefit true sexual assault victims. A lot of times in cases of rape, the perp can not "perform", so he forces oral sex. This is when this law is beneficial. In the case of this poor boy, it was used to abuse the system, just as many laws are. I do not want that law to go away, it just needs to be used for the purpose it's there.

kbp, we have had the situation before where all 4 judges recused themselves. It is up to the DA's office to find a judge from another district to preside. In the Echols case, I believe they are using it to stall the trial....again. They are trying to bury it, but at the same time, not drop the charges. It's a game to them, and they will lose. Since Echols is innocent, he WILL force the issue to find another judge. He & his attorney know what they are trying to do & it won't fly.

volfan, the federal suit will be in Rome which is the location for federal anything in this district. It is a different rodeo once you step into federal land. I think you live in the Chattanooga area. If you get a chance sometime, go to the federal courthouse downtown & watch a few hearings or even a case. There are several coming up that are quite interesting. But, you will see how real judges act and conduct court. They can quickly repeat case law & federal statutes. It's quite interesting & educational.

Anon 1:18. If you're still reading this thread, the case I mentioned was to show that your state's AG can't be trusted to do the right thin in the Echols case. The reason he was put in prison for 10 years was because of a loophole. Had he had intercourse with the girl he would have only been guilty of a misdemeanor, not a felony. Oral sex was illegal, even between a married man and women, until recently in Georgia. That loophole has since been closed, but it did not correct retroactive cases, including that one. So, your AG was fighting to keep a boy in prison for 10 years for a crime that now only calls for less than a year in prison, and doesn't require sex offender registration. That's what I'm saying, the guy is more concerned with showing himself tough on crime than seeking that justice be done. Don't count on him doing ANYTHING right in the case of Eric Echols, an African American--the boy in the case I mentioned was also African American.

I agree with your assessment, I was just explaining that law & it's benefits. I will explain. I'm a true fighter for justice. Period. I wrote a lot of letters & made a lot of phone calls for that young man. He was used & abused by our system and it broke a lot of people's hearts all over this state. It opened a lot of eyes too, but since, eyes are beginning to close & that's what scares me. I know Baker is corrupt. Remember, I live here and am very politically & socially active, so unfortunately I know all of our politicians in this state, keep up with their voting & try my best to campaign for the "little" guys and girls. I'm a believer in one shot or you're out & hate to see people only get elected because of a name or because the amount of money they have. I keep up with a lot of injustices and do what I can to right the wrongs. I'm glad you are interested in our politics now, and if you still have relatives here, please discourage them for voting for Baker or Deal. They are both crooked as hell & it is soooooooooooooo scary to have them running for the leader of my state.
