More Updates on Tonya Craft Case: Will Georgia Voters Return Buzz and Outhouse to Office?

[Update]:Today is election day in the LMJC, and while House has no opposition and will be returned to the bench, there is a choice for district attorney. While I don't know Doug Woodruff and have not followed his campaign, nonetheless Buzz Franklin needs to be replaced if for no other reason than to send a message that people like him do not belong in public office.

This is not an official endorsement of Woodruff, but consider it to be an official Non-Endorsement of Buzz Franklin. That man does not deserve a single voter, period. [End Update]

In 1990 I was a jury foreman in a civil case in Walker County. The jury found for the plaintiff and afterward, the defense attorney and I had a long conversation about the strengths and weaknesses of his case.

Likewise, prosecutors often will speak to jurors after a verdict, be it guilty or not guilty. Prosecutors like to know what they did right -- and what they did wrong.

However, following the Craft verdict no prosecutor spoke to a juror. In fact, some of the jurors actually attempted to contact Buzz Franklin's office in order to be able to speak to either Chris "Cruisemaster" Arnt or Len "the man" Gregor. No one in that office was interested in speaking to a juror despite the opportunity.

This is highly suspicious. I have known prosecutors who believed they had a good case and lost, and they wanted to know why. In this case, Franklin even put out a statement after the trial attacking the jury and making a claim that Arnt and Gregor had put on a "compelling case for conviction." Now, if these men really believed Craft was guilty and that they had presented a great case to jurors, then I am sure they would have wanted to know what went wrong.

Instead, they continued to claim jury misconduct and lamented a child molester being set free. In other words, they continued to lie.

Lying is something that both Buzz Franklin and "judge" Brian Outhouse do, and they do it with ease. Outhouse, when confronted about a piddly thing like a campaign sign, lied to Channel 3 News. In other words, he could not even tell the truth about a small thing.

One hopes that the voters of the LMJC have had enough of these two miscreants. Franklin not only lied in his press release after the Tonya Craft acquittal, but he also refused to meet with any Craft jurors to find out just why they disagreed with him and the "compelling case for conviction."

If the LMJC voters do re-elect Franklin and Outhouse, they will be making a statement that they prefer dishonesty to honesty. Also, they had better hope that they don't fall into the system the way that Tonya Craft, James Combs, Brad Wade, and others have done, for they will find out the hard way that there are no honest people employed in the LMJC, or if they are honest, they are quite silent.

Another Big Lie from the Authorities: Innocent People Don't Plead Guilty

Ten years ago, Brian Banks, a high school football star from Los Angeles with a promising future, pleaded "no contest" to raping and kidnapping classmate Wanetta Gibson in a school stairwell. Despite the evidence to the contrary, Banks' attorney advised the youngster to plead "no contest" (which essentially is a guilty plea) with the assurance that he only would get 18 months, as opposed to a possible 41 years if he was found guilty.

Banks and his family did the math and he pleaded, and five years later, he still was in prison. After being released, the girl finally admitted to having lied, but did not want to publicly admit the truth because her mother had sued the Los Angeles School District and got $1.5 million. Having essentially stolen the money in the first place, they did not want to be faced with giving it back.

The various news stories have turned it into something in the human interest category, as though it were a heart-warming account instead of the cold-blooded lie that essentially took a young man's life from him. As I see it, the media is missing the real story, which is this: the entire system of "justice" in California, despite huge holes in the girl's story, was ready to assume that she was telling the truth, the whole truth, and nothing but the truth.

Why? As in the Duke Lacrosse Case, the various players in the system discarded forensic evidence, timelines, and the very Laws of Time and Space to rush to a judgement of GUILTY, but the rush is not simply a psychological event, but also a legal one, and one can trace a lot of the rush to federal law, and specifically the Violence Against Women Act.

In 1974, Congress passed the Mondale Act and the ultimate result was a huge rash of cases in which authorities were REQUIRED to rush to judgment no matter how outlandish the charges of child abuse and molestation. The Mondale Act and Violence Against Women Act were similar pieces of legislation, in that they promised federal help and money (lots of money) to states that were aggressive in pursuing child abuse/molestation charges and charges of rape and sexual assault against women.

Besides the money, Congress also stipulated that states change how they approach due process and how they viewed evidence. Before the VAWA, for example, many states required that with rape charges, there also be corroborating evidence because it was too easy for people to make false accusations. In order to be in compliance with both the VAWA and the Mondale Act, however, states had to just accept the word of a "victim," no matter how outlandish or dishonest the story might have been. In the Wonderland of federal law, the accusation alone is all the proof the authorities need for conviction.

To the feds and all of the activists that were behind these laws, no story would be considered outlandish, because everyone knew that all men were rapists or potential rapists and that all parents actually were secret child molesters (or at least those parents and men who did not have the proper political connections). We know the results, and they are ugly.

To the Progressive mindset that is behind the modern governing philosophy, both child abuse/molestation and rape were "epidemic" until Congress and the U.S. Department of Justice stepped in to put an end to the violence. Thus, any criticism of these laws or any attempt to restore due process of law or to demand that the rules of evidence actually require real evidence is seen as an attack on women and children.

Without the Mondale Act, there is no McMartin Case, no Little Rascals, no Tonya Craft, and no Creative Frontiers. There is no rash of false accusations of abuse/molestation in child custody cases, no Joal Henke and his "I just remembered" perjury, and James Combs does not plead guilty to a felony for something he never did.

Without the VAWA, there is no Duke Lacrosse Case because the investigation would have been very, very different. And Brian Banks would not have spent five years in prison, and thousands -- yes, thousands -- of other people would not have been falsely accused.

In the United States today, defendants face mountains of charges, courtesy of how prosecutors operate, so that conviction on any one of them can result in decades in prison. People come to understand that the system is stacked against them and that in this country, neither judges nor prosecutors nor those that govern consider innocence to be a legitimate defense.

Despite what one might see on the various "CSI" shows or see on TV or the movies, police no longer do real investigations. In cases of accused rape, sexual assault, child molestation or child abuse, police ARE REQUIRED BY LAW to "investigate" as though the charges are true, which means the bias always is toward "proving" guilt. One should not be at all surprised that this federally-mandated method of "investigation" bleeds off into other cases such as robbery and murder, which guarantees not only that there will be a spate of wrongful convictions, but also that the system will be utterly biased toward keeping such convictions from being overturned, no matter how obvious it might be that the defendants were railroaded.

As for Brian Banks, a number of people engaged in criminal behavior, beginning with Wanetta Gibson. However, the police and prosecutors engaged in false accusations and false charges, people lied to a grand jury that indicted, and prosecutors lied in court. Banks' attorney encouraged him to accept an outcome at odds with justice, and Gibson and her mother stole more than a million dollars from taxpayers, as did their attorney, who got at least a half-million dollars from the theft.

Unfortunately, false pleas are not limited to just these kinds of cases. I have a good friend who pleaded guilty to a number of things that both he and the prosecutors knew he did not do, but did so because had he not done so, prosecutors would have brought vague charges against him in the federal court in Washington, D.C., and he being a Jewish Republican, did not want to face a jury of mostly African-American Democrats.

That is the system we now have, and it cannot and will not be fixed. No "reforms" will work because too many people make too much money and the voices of justice and responsibility are drowned out by those who dominate our political and legal institutions.

Justice for James? Certainly not in the LMJC or Hamilton County

Honest and decent people do live in the United States, but they no longer work in the "justice" system. Instead, we are seeing a system that is populated with liars, criminals, bullies, and people who have no place in a decent society.

If there is any place in the USSA where that especially is true, it is in the heavily-churched and supposedly "Christian" area of Northwest Georgia, the Lookout Mountain Judicial Circuit. On Sundays, many of the players in the LMJC go to church and sing about Jesus, and then the rest of the week, they worship their real god, the Devil.

Why do I wrote so graphically? Let me quote Jesus (whom Brian House and Tim Deal claim to worship) who told the Pharisees in John 8:44:
You are of your father the devil, and your will is to do your father’s desires. He was a murderer from the beginning, and has nothing to do with the truth, because there is no truth in him. When he lies, he speaks out of his own character, for he is a liar and the father of lies. (ESV)
Deal has lied under oath and at least on one occasion, fabricated a document in which he claimed to be somewhere where he was not. House has lied about his ex parte meetings with prosecutors and went along with Chris Arnt when Arnt openly lied to jurors in the closing arguments of the Tonya Craft trial. In other words, both of these men, along with prosecutors like Arnt, Len Gregor, and Alan Norton are all about lies, and according to the Jesus these men claim to follow, Jesus said that people who lie (and lie consistently) have Satan as their father.

All of this leads me to the present situation of James Combs, who agreed to plead guilty to a misdemeanor in House's court because, to be frank, he could not trust House to run a fair trial, Norton and Deal to tell the truth, and a Catoosa County jury to listen to evidence. That is a damning indictment upon the people of Catoosa County and Northwest Georgia, who have put these people into power.

From what I have been hearing, Deal and Norton have tried to get James listed as a "sex offender" in Tennessee (where he lives and will be under probationary supervision) even though the misdemeanor to which he pleaded guilty does not carry the "sex offender" label. Nonetheless, dishonesty rules not only in Catoosa County and the LMJC, but also in Hamilton County, home of gang warfare, brutal (and dishonest) cops, and prosecutors who look the other way when felonies are committed in front of them.

From what I also understand, local cops are constantly harassing the Combs family. What can I say except that this kind of behavior from those who wear the blue costumes can be expected.

When Joal Henke testified in October 2010 in Hamilton County Circuit Court (Judge Marie Williams), he committed perjury and then admitted to having committed mortgage fraud, which is a federal offense. In fact, today, I just signed a paper in which I acknowledged that mortgage fraud is a felony punishable up to 30 years in prison.

So, Henke committed two felonies in Hamilton County, one a state crime and the other federal. But does Bill Cox or the local U.S. attorney care? Well, of course not! Why pursue criminals when one can harass and imprison innocent people?

If people wonder why I am so cynical about Chattanooga and North Georgia, all I can say is to look at the liars and thugs that inhabit "law enforcement" and "justice." I continue to wonder if there are any decent people left in public life in my old hometown, but I am having my doubts.

Way to go, Norton; you "won" a "victory"

The Times-Free Press today is reporting that James Combs has given a guilty plea of "cruelty to children" in exchange for the office of Mr. Perjury (Buzz Franklin) dropping charges against Mr. Combs of "child molestation." James will serve no time and will be on probation for six years.

The article is self-explanatory and I won't add anything to it except to say that it is utterly clear to anyone (besides officers of Perjury Central, LMJC) that Tim "Dirty" Deal manipulated the boys in the taped interviews to make the accusations against Mr. Combs. Dr. Nancy Aldridge, one of the world's best experts in questioning children about molestation and sexual abuse, was going to testify for the defense that Dirty's questioning was coercive and misleading.

That is not how Alan "I Sold My Soul" Norton puts it. According to the TFP, he claims to "believe the children," but did not want to put them through any more trauma. That is rich; the LMJC coached Sandra Lamb's daughter, the McDonald girl, and Tonya Craft's daughter and had no problem with having them lie on the stand.

No, Norton was able to play on Mr. Comb's real fears that he was walking into a courtroom where none other than Brian House sat as a judge (although the man at best is qualified to change sheets at a roach motel). Knowing House's penchant for trying to rig a trial, Mr. Combs decided not to risk the lies and abuse that surely would follow. I can understand what he did, and I believe fully in his innocence.

Keep in mind that Norton was going to claim that almost as soon as Mr. Combs walked into the classroom as a substitute teacher almost two years ago, he openly began molesting children. Right. And, no, the kids did not get the story straight, but stuff like that does not matter when Mr. Perjury is the DA.

I wish the Combs family well, and I wish nothing but ill for Alan Norton and his career as a professional liar. The LMJC is nothing but a cesspool, a repository for liars, sex perverts, and outright criminals wearing suits, blue costumes, and judges' robes. But, as long as voters in Northwest Georgia are happy with the status quo, nothing is going to change.

So, I guess Norton has "made his bones." Given that the LMJC makes the worst Third World dictatorships look good, I guess it is not hard to win "the big one."

An open letter to Alan Norton

This week, the child molestation trial of James Combs is set to begin in Catoosa County, and if what I have seen of the interviews that Tim "Dirty" Deal did with the accusing children, we have another farce on the dishonesty magnitude of Tonya Craft. If there is anything we CAN know before the trial begins, it is that Combs is innocent of the charges and that if you, Mr. Alan Norton, prosecute this case, you will have to suborn perjury to do it.

So, I ask you, sir, the following question: Is it worth it to sell your soul in order to follow Buzz Franklin's orders? Before I go into the Combs case, let me remind you that Buzz already demanded that you suborn perjury in the failed Higgenbottom case in which you were supposed to depend upon a "jailhouse snitch" that you knew from the start was lying.

Do you remember Eric Echols? Yes, you were supposed to lead that trial, too, and you had video evidence of his being assaulted by "Mommie Dearest" Sandra Lamb, who called him a "black bastard" on camera. Yet, despite the overwhelming evidence to the contrary, you were going to try him for felonies you knew he had not committed.

Mr. Norton, what is it about the LMJC that leads someone to sell his soul? What is it about the influence of Buzz Franklin and Chris Arnt and Len Gregor and Tim Deal and Phil Summers and Brian House that would lead a man to knowingly suborn perjured testimony?

I have no idea of you believe in God, Mr. Norton, but prosecutors who lie to juries and coach witnesses to lie are not going to be entering the Pearly Gates, sir. I hate to tell you, but the Georgia State Bar does not control the entry roster for Heaven, and while they have your back in Atlanta when it comes to committing felonies while acting as an officer of the court, God is not particularly impressed with the state of "justice" in Georgia and is likely to mete out some justice of His own.

Is it really worth it to work for these people, sir? I can tell you that they would sell you down the river with smiles on their faces if they thought they could get away with it. I also know enough about one of your LMJC colleagues to know that you don't want to leave him alone with either your wife or your daughter (should you have either or both). True, those who are employed by the LMJC are permitted to commit sexual assault and worse and not face any prosecution or even arrest, but nonetheless I doubt you would be much pleased if one of those LMJC employees were to do such a number on one of your family members.

You really do have a choice; you can get out, resign, leave the LMJC altogether. I have no idea if you have a conscience or even one shred of decency in you, but if the answer to either is "yes," then you cannot afford to stay a minute longer in that employ unless you want your final dwelling place to be Hell itself.

Even if you have a conscience, the people who are your LMJC colleagues do not. When Len Gregor managed to bamboozle a jury to convict Brad Wade -- whom all of you know was and is innocent of the charges against him -- do you think the man lost a minute of sleep? When Chris Arnt, Gregor, and House were having secret (and illegal) meetings to plan how they would try to railroad Tonya Craft into prison, do you think any of them were concerned that they were breaking the law and engaging in the worst kind of unethical conduct?

When Arnt lied to jurors in the Tonya Craft closing arguments in which he made an open and obvious dishonest statement about the testimony of Dr. Nancy Fajman, do you think it bothered him even a whit that he was lying? When Brian House desperately was trying to keep Craft's lawyers at bay by granting 90 percent of the prosecution's objections during the trial, do you think he worried that maybe the appellate courts would criticize him?

Let me be honest (since no one else in the LMJC seems to want to tell the truth). You can work in this job for a long as you want, and you can lie, coach others to lie under oath, help convict innocent people, and generally live a life of crime, and nothing will happen to you. That's right, nothing. No one from the State of Georgia will intervene, and the U.S. Department of Justice will whistle right past you, no matter how egregious your conduct.

But if you stay in that office as a prosecutor, you will be selling your soul and destroying whatever conscience you might have, and a man without a conscience is nothing more than a psychopath. I hate to say it, but you already work with sociopaths and their influence upon you only can make things worse.

Let me ask you this question: If you had a relative or loved one on trial, would you want to see Chris Arnt and the prosecutor, Brian House in the judge's seat, and Tim Deal testifying on the stand? Could you trust any of them? If the answer to any of these questions is "no," then you also have to understand that every day you work among these people brings you one step closer to Hell.

Yes, leaving a job and one's home is difficult, especially in this time of an uncertain economy. Having to earn a living as a private attorney can be unsettling and there is no guarantee of a regular paycheck as there is when you are in Buzz's employ.

However, if you continue to stay, you will be destroyed from within. You will have to sell your soul and one day the Devil himself will come to collect.

It is too late for Arnt, Gregor, Buzz, Deal, and House. They are beyond hope and beyond redemption. Pharaoh after the Ninth Plague had a softer heart than do these men. I hope it is not too later for you, but you need to ask yourself if you spent all of those tough years in law school so that you could take orders from some of the most unethical and dishonest people on this planet.

Gregor once wrote on a blog that he went to law school so that he could be a prosecutor and be (in his words) "the man." I have no idea if the guy is a "man" at all; I do know he is a bully, a coward, and a liar, and while he apparently thought his bombast and bullying during the Craft trial was impressing the jurors, it turned out that they thought he was a bully and a creep.

Why would you work with someone like that? You don't have to do it, and you do not have to hang around so that you can share a condo in Hell with "the man."

Indeed, if you resign and leave the employ of the LMJC, you really will be a man because you will have done something that people like Buzz, Gregor, Deal, House, and Arnt are not capable of doing: engage in an act of real integrity.

The LMJC and the Culture of Legal Corruption

When my family moved to Lookout Mountain in 1964, I must admit that parts of the region known as Northwest Georgia were reminiscent of places I have seen in Third World countries. Until moving there, I never had seen tarpaper shacks, children at school with what seemed to be permanently dirty faces, and general, grinding poverty.

Much has changed in that region since then. While there still are poor people, the poverty I saw hardly is widespread anymore, and in many ways, the region can be a pleasant place in which to live. Unfortunately, its legal climate is still stuck in 1964, a time when it was de facto legal in the Lookout Mountain Judicial Circuit for a white man to murder a black man.

My father brought us down to the LMJC when Covenant College moved from St. Louis to the old Castle in the Clouds, and at Covenant, which is located in Dade County, black students were told in no uncertain terms that they were NOT to be seen walking south of the college's property, and especially along Highway 157. In fact, over the years, a number of black students did receive death threats from the good people residing in the LMJC, but no one was killed. I'm sure that had someone killed one of Covenant's black students, he would not have been charged or prosecuted.

This was a time when the Dade County portion of Sand Mountain had a sign that declared: "N*gger, don't let the sun set on you here." The people there meant every word, and I still would caution any black person from venturing up there without an armed escort. That was the kind of place the LMJC was then, and while I don't see the same overt racism that once characterized the place, the area's "justice" system is racist, as Len Gregor proved during the Tonya Craft trial, when he lied to jurors, telling them that Ms. Craft has slept with a black man.

Now, for the most part, I do consider many of the people living in the LMJC to be honest, or at least decently honest. Unfortunately, they put up with a culture of corruption that exists with police, prosecutors, and, yes, judges.

To be fair, the LMJC hardly stands alone. My friends from Texas tell me horror tales of Williamson County police, courts, and prosecutors, and K.C. Johnson has a great post on his blog about the legal corruption that permeates Durham County, North Carolina. Interestingly, in many ways, the corruption of the LMCJ and Durham County seems to be similar.

What makes this point even more interesting is that demographically and politically, the two places hardly could be more different. The LMJC is overwhelmingly white and politically conservative. The most prominent college in that district, Covenant College, is both theologically and socially conservative. The region abounds with "Bible-believing" churches and I would venture to say that a large portion of the population claims to be "saved."

Durham County, on the other hand, is dominated by the hard left, including a coalition of blacks and activists associated with Duke University. Duke would be the antithesis of Covenant, its student body dominated by "hookup" culture, and the university does everything it can to promote gratuitous sex by handing out condoms everywhere and promoting disgusting things like the "Sex Workers Show" on campus. The university there is not "liberal" by any means; no, it is hard left, and though it is tied to the United Methodist Church, the university itself is virulently hostile to anything that might smack of Christianity.

Yet, when it comes to issues of justice, these communities are mirror images of each other. Durham was made infamous by its attempt to railroad three Duke University lacrosse players into prison for allegedly raping a black stripper, Crystal Mangum. As the case wore on, it became clear that the prosecutor, Michael Nifong, was lying and hiding exculpatory evidence, even while he rode the case to electoral victory, as the black voters of that county demanded a trial (and one person told Newsweek that it did not matter if the players were guilty, as they should be convicted solely because they were white).

The North Carolina State Bar intervened, and ultimately the charges were investigated by special prosecutors employed by North Carolina's attorney general. After a thorough investigation, the AG declared the players to be "innocent" and told the media that Nifong was a "rogue prosecutor." Later in 2007, the State Bar stripped Nifong of his law license, and he was removed as Durham County's AD.

Just five years later, Nifong's successor, Tracey Cline, a black woman who was second chair in the lacrosse case (and who lied about her involvement in it -- lying is part of the legal culture in that county), was removed from her office because of inflammatory statements she made in publicly attacking the senior judge in that county. (The judge also is black.) So, twice in five years, Durham County has seen its top prosecutors removed forcibly from office for misconduct.

-------------------------------------------------------------------------

So, why would I compare the LMJC to Durham, despite all of its cultural and racial differences? Like Durham, the prosecutors in the LMJC have a sorry history of withholding evidence and fabricating documents. Unlike Durham, there is no state bar and apparently no judicial or legal apparatus at all in the State of Georgia that effectively deals with prosecutorial misconduct.

However, like Durham, the LMJC has a policy of taking sex cases to trial no matter what the evidence might be. And like Durham, prosecutors in the LMJC always take the side of an accuser in a sex crime, no matter how specious the evidence actually might be, and like Nifong, LMJC prosecutors, once they latch onto a sex case, take a "win at all costs" mentality that throws justice out the window.

It was not just the Craft case. Brad Wade sits in prison and the case that Len Gregor brought against him was so dishonest and so bogus that it is hard to believe he was convicted of child molestation. The reason is one more strike against the LMJC: defense attorneys in that district know that their job is to offer up defendants to the altar of conviction.

Now, when someone is charged with a crime in the LMJC, that person faces a terrible dilemma: hire a local attorney (which prosecutors and judges prefer) and automatically get convicted, or hire someone outside the LMJC who will be roundly attacked by prosecutors, sneered at by judges, yet might be willing to put up a real defense. In the Craft case, prosecutors Chris Arnt and Len Gregor routinely launched verbal attacks against Tonya's defense team, made snide remarks, tried to disrupt defense attorneys while they were questioning witnesses, yet "judge" Brian House not only ignored the misconduct of the prosecutors, but actually teamed up with them in an attempt to rig a conviction.

(While I know there are some attorneys in the LMJC who have integrity, nonetheless the judges and Buzz Franklin and his minions have made it absolutely clear that an aggressive defense is not permitted -- even while prosecutors are permitted to run wild. The one exception is Bobby Lee Cook, who is permitted to win once in a while.)

The jurors in the Craft case did something that neither House nor the prosecutors ever could imagine them doing: demonstrate integrity. The shocked, ashen look on House's face when the verdict was being read spoke volumes to the integrity or the lack thereof of the people in the LMJC who are in positions of authority.

You see, if there is one thing that I believe characterizes the LMJC is the belief of the principals in that district who really seem to believe that they ARE the law, and that they are entitled to do whatever they damn well please. Anyone who followed the Duke Lacrosse Case can attest to the arrogance of prosecutor Mike Nifong and everyone else in the Durham "justice" system. Like Buzz Franklin, Arnt and Gregor, Nifong knew that his authority alone could force a bogus case to trial, and he also believed that a Durham jury would be craven enough to convict the players despite the fact that Nifong had no evidence -- and he knew he had no evidence, which is why he continuously lied to judges throughout the proceedings.

Likewise, House teamed with Arnt, Gregor, and Tim Deal not only to help Deal commit a felony (fabricating a document during the trial in order to fill a huge hole in the evidence), but also meeting secretly with the prosecutors in order to further their strategy. Observers at the hearings before the trial began told me that House was utterly hostile to ANY attorney for Craft that did not come from the LMJC and that he routinely and automatically ruled against the defense no matter how ridiculous the prosecution's position might have been.

The trial itself was a farce, but the difference -- and this was a huge difference -- was that the jurors did not take the bait from House and the prosecutors and act in a hostile manner toward the defense. House, Arnt, and Gregor believed that the jurors automatically would discount EVERYTHING the defense did because neither they nor their expert witnesses were from the LMJC, but that is not what happened. Instead, the jurors acted like people who wanted to do justice, and did not act like House, Arnt, and Gregor.

-----------------------------------------------------------------------------

All of this raises a question as to why this kind of legal corruption exists in the LMJC. Why are police and prosecutors permitted to literally commit felonies in broad daylight, yet nothing is done? Why the silence from the media and the other gatekeepers, and especially the churches and the largest and most influential "gatekeeper" in the LMJC, Covenant College?

Other than one pastor, no one in a position of influence has spoken out about the massive lawbreaking, lying, and misconduct that has become the very trademark of the LMJC. During the Craft trial, no one from Covenant demonstrated a whit of concern as to what was happening, and at least one administrator there is friends with Holly Kittle, who to me represents everything that is wrong with the LMJC.

(Covenant says that it is "reclaiming the world for Jesus Christ," but the one part of the world that matters -- its own backyard -- apparently is off-limits when it comes to "reclaiming" for Christ. As I see it, the people there believe that legal trouble is for "other people," and if by chance someone from Covenant were to be falsely accused, most likely the administration and faculty there would do what evangelical Christians usually seem to do when one of their own is in crisis: shoot their wounded and move along.)

In the end, we see small, dishonest people gaining enormous amounts of power and authority, and they use it like a club against the innocent. Tonya Craft, Brad Wade, and James Combs can tell you that when it comes to dishonesty, no one does it better than the police, judges and prosecutors of the LMJC. Perhaps in my lifetime, someone, somewhere in a position of authority in Northwest Georgia will do what is right, but I have my doubts.

Michael Rasmussen's Trial is Postponed Until May

The latest news is that Michael Rasmussen's trial will be postponed until May 16. This is due to a private family matter with his attorney.

The bad news is that Mr. Rasmussen remains in jail for the next 2-1/2 months. However, the good news is that the defense gets to strengthen its case.

One thing I have learned in my experience in blogging on these kinds of cases is that bad cases tend to grow worse over time, and that if the police and prosecutors have built charges on sandy ground, the ground turns into quicksand. That is the situation with this one, as the prosecution has had two years to "get its story straight," and so far every new bit of information helps, not hurts, Mr. Rasmussen.

Anyway, stay tuned. In the meantime, there is the Jacobson case in Arizona, as well as the wrongful imprisonment of Courtney Bisbee, and both of them will be receiving some attention. Furthermore, there is the upcoming trial of James Combs in Catoosa County, which will feature some of the same faces that polluted the courthouse during Tonya Craft's trial.

So, there is much work to be done.

Well, Buzz, What Is It? In Secret or in Public?

[Note]: What I am writing in the James Combs case is not part of a "defense strategy," no matter what Buzz Franklin, Tim Deal, and others might be saying. I am a former resident of the LMJC who is sick of watching outright criminal behavior by those who are supposed to enforce the law and watching these people act like animals, destroying the lives of innocent people and their families. Thus, ANY claim by LMJC officials that I am acting in concert with the Combs defense is a lie, a very wicked and open lie. (Not that anyone in the LMJC is worried about being caught lying.) [End Note]

When Buzz Franklin issued his infamous May 14 press release excoriating the jury in the Tonya Craft trial for not following the instructions of his henchmen "Alberto-Facebook" and "The Man" to convict Ms. Craft with no credible evidence, he made the following statement:
Child molesters rarely commit their crime in public. Child molesters rarely confess. Child molesters are rarely caught on tape. Child molesters rarely leave behind physical evidence. A jury must often make a choice between the testimony of an abused child and the alleged perpetrator. If a jury refuses to convict without videotapes, confession or physical evidence, it will be impossible to convict most child molesters.
You see, in the James Combs case, Buzz and his lackey, Alan "Wannabe" Norton, along with Holly "Thumbs Up" Kittle and Tim "Dirty" Deal, are going to try to convince a jury that Mr. Combs committed his "crime" in a very public place: a classroom full of children. So, in this situation, we have Franklin in a quandary: Is this done in secret or in full view of lots of people? Buzz wants to have it both ways.

You see, in Tonya's case, he was claiming that the jury was wrong because Ms. Craft supposedly did it in "secret." Since the jurors did not think that the terribly contradictory testimony from ALL of the prosecution witnesses, plus the utter childish behavior from "adults" like Sandra Lamb, Sherry Wilson, Kelly McDonald, and the CAC crowd (not to mention the obvious perjury committed by many of the same) was "a compelling case for conviction," then the jurors were stupid and bad.

Now, the supposed ethical standards of the Georgia State Bar that apply to prosecutors (which are never enforced) say that prosecutors should not attack jurors after a verdict they don't like, but Buzz, like all of the others in the LMJC, is above being disciplined. The law does not apply to him or the ADAs or the judges or police, period.

In the Combs case, however, Buzz is changing his approach. Now we are supposed to believe that a man who has gone through a large number of legal background checks and never before has been accused of sexual misconduct suddenly is so overcome with lust that while he is sending two misbehaving boys to the principal's office, he first sexually molests them IN FRONT OF EVERYONE, but no one but the boys seem to notice. As I have said before, this does not pass anything close to a smell test.

Now, if I know how things work in the LMJC, "Dirty" Deal will try to work on the other children who were in the classroom, trying to get them to lie in order to give prosecutors what they want. (After the Tonya Craft debacle, the LMJC is DESPERATE for a child molestation conviction and will tell any lie and twist the law in order to try to achieve it.)

If you see how the police and prosecutors worked over Jerry McDonald, threatening him with prosecution if he did not say what prosecutors wanted, you can get an idea of how they are likely to proceed with the other children in the classroom and their families. (They threatened to charge him with "obstruction of justice," and I also guess that they threatened to charge him with perjury for not being willing to commit perjury. So goes the "law" in Northwest Georgia.)

Furthermore, Franklin's minions tried to pressure Kim Walker to claim that her daughter was a Tonya "molestation victim." In fact, the Walker child had an interview in which it was established that "nothing happened." Chris Arnt then demanded that the child be subjected to a SECOND interview, but Ms. Walker refused. Thus, when she testified for the Craft defense, she told of being threatened by some of the other parents and receiving pressure from prosecutors.

Interestingly, the prosecutors, who arrested private investigator Eric Echols for simply doing his job (and doing it legally), never seemed interested in looking into incidents of witness intimidation done by themselves and their own witnesses. But, then, the LMJC is a place where those entrusted with enforcing the law believe the law does not apply to them.

So, once again, Buzz Franklin and his gang of criminals will seek to take a good and decent person and try to railroad him into prison despite the fact that everyone in a position of authority in the LMJC knows that Mr. Combs is innocent of the charges. Unfortunately, innocence is the last thing that matters in the LMJC, where winning at all costs seems to be the motto.

Who Is Holly Kittle? Part II

My earlier post on Holly Kittle apparently has struck a nerve with some people in the LMJC, with one of Kittle's supporters writing:
Mr. Slanderson,
You continue to be both judge and jury for those invovled (sic) in these cases. You talk about the Bible as if you may know it but you tend to judge others more than any other person I have had the displeasure of listening rant their nonsense. You have found your 15 minutes of fame and are now running with it acting as your (sic) are the swift justice to save North Georgia and all "innocent" child molesters (because your logic seems to believe their [sic] is no such thing as child molestation, maybe you are a child molester and thats (sic) why you have this strong view on the topic, yet I feel you have crossed a line with your latest blog. I hope God judges you as harshly as you judge others.
The point that Kittle's supporters are making if this: if someone is accused of being a child molester, then the person is automatically guilty and anyone who disagrees is doing so because that person also is a child molester. This is what passes for "law and justice" in Kittleworld.

(Important: I have concentrated on three child molestation cases in the LMJC, Tonya Craft, James Combs, and Brad Wade, even though there have been others. The reason is twofold: first, I cannot deal with every case, and, second, I believe that some of the other cases are legitimate. The ones I have emphasized have featured either contradictory or utterly implausible testimony, prosecution-suborned perjury, "expert" prosecution witnesses who should not be permitted inside a courtroom, and misconduct by prosecutors and judges. Unfortunately, Kittle's supporters have translated that into my being a child molester.)

The question is this: Why am I featuring Kittle and why am I speaking out so harshly against her? My sense is that Kittle and her friends believe I am treating her unjustly, but in this situation, justice seems to be in the eye of the beholder. I believe strongly that Kittle's behavior during her cross-examination in during the Tonya Craft trial reflected both ignorance of how her job should be carried out and arrogance that she seemed to believe that no one ever should question her.

Furthermore, by publicly approving the comments in Chris Arnt's Facebook forum when he attacked Tonya Craft and her defense, Kittle not only acted unprofessionally but also was guilty of misconduct for someone in her line of work. That she was nasty, arrogant, and haughty during her testimony only confirms to me that Kittle, like so many others in the LMJC, believes that the law only applies to those who are not part of the "injustice" system. In a real court of law, she would not be permitted to testify at all, at least as an "expert."

Why do I believe her to be incompetent? First, as I will point out in this post, her interview with Sandra Lamb's daughter on, quite appropriately, April Fool's Day, 2009, violated all standards of forensic interviewing and NEVER should have been entered into evidence as "proof" that Tonya Craft had molested anyone.

Second, Kittle admitted during her testimony that she did not keep current on literature, and then later told Arnt (on re-direct) that she had been reading up-to-date materials. However, when asked by Dr. Demosthenes Lorandos the titles of what she supposedly had been reading, Kittle had no recollection. This is not someone who actually is trying to find the truth; this is someone who believes her job is to try to fix a case for the prosecution, and people like that have no problem with fudging the truth or even outright lying (since they know they won't be charged with perjury).

For the sake of length, I will not include the transcript of Kittle's interview with Lamb's daughter, but it is available here, and the interview and the comments that I wrote afterward (with help from an experienced analyst not connected with the Craft case) put the whole thing into perspective.

What the child told Kittle was absolutely preposterous, yet Kittle was all ears. However, I did not point out in that article that Kittle violated an important protocol in the forensic interviewing of young children: she left the room during the interview, not once, but twice.

In the Chattanoogan's account of Kittle's testimony, we have this gem:
The young child, six years old at the time of the alleged incident, told the interviewer that Ms. Craft had inserted all of her fingers in her ‘privates’ and one finger in her rear. The defense would later question the physical possibilities of this happening. The witness told the defense counsel that she had never considered that possibility. (Emphasis mine)
So, here is an "expert" who never considers the possibility that a "hand rape" such as what was described was even physically possible, and if it actually happened, why there was not severe damage to the child's private parts. Instead, Kittle acted like a stenographer while claiming to be a well-trained "forensic interviewer."

Likewise, I suppose that when Kittle interviewed the two boys who are claiming that Mr. Combs molested them in a classroom, it never occurred to her that since the room was full of children, perhaps others might have witnessed such a scene. Why didn't a bunch of children come forward? While I don't have access to the transcript of that interview, nonetheless I have no doubt that Kittle was both incompetent and dishonest, seeing her job as helping Buzz Franklin's office railroad Mr. Combs into prison.

After the trial, Kittle gave an interview to WDEF-TV that demonstrated her own arrogance:
Holly Kittle says, "I do not go into an interview searching for anything. In fact, I go into an interview hoping that this has not happened."

Holly Kittle is a forensic interviewer for the Children's Advocacy Center and interviewed one of Tonya Craft's accusers about a year after the allegations came out.

She says she's trained to the Children's Advocacy of Georgia standards. Kittle says she asks the kids open ended questions, not leading or suggestive ones like Craft's defense suggested.

Kittle says, "I felt like I was personally attacked, but my interview and my job was minimally attacked."

Kittle says she keeps and open mind and even looks into an alternative hypothesis.

Kittle says, "I know how to do my job, and I know that I was trained to do my job, and I do my job to the best of my ability."
So, even to QUESTION what clearly was a sub-standard "forensic interview" was to personally attack Kittle. Yet, in doing research for an article on the Craft case, Kittle's interview stood out (as did the rest of the CAC interviews, including those by Stacy Long and Suzi Thorne) as how NOT to interview children.

Believe it or not, I am not motivated by a personal animosity toward Holly Kittle, although I will say openly I have nothing but contempt for her and her CAC and LMJC colleagues. Instead, I am attacking the quality of her work and the fact that she is part of a machine that seeks to destroy people who clearly are innocent of the crimes of which they are accused.

Kittle, because of her job, has the power to help destroy innocent lives. However, I get the sense that she really enjoys the influence and "prestige" that being a "forensic interviewer" brings. Because the consequences of destroying innocent lives are so great, I believe that someone must speak out when people like Kittle are acting in an unprofessional and haughty manner and promoting false testimony instead of the truth. That is what I am doing, and I don't care if some people in North Georgia don't like it.

Who Is Holly Kittle? Part I

One of the worst episodes of prosecution witness testimony in the Tonya Craft trial came when Holly "Thumbs Up" Kittle took the stand. Kittle proceeded to proudly note that she could not recall any relevant literature to her profession (she claimed to read stuff, but could not remember any titles or information, which is more proof that she needed to take Joal Henke's "recovered memories" course).

Furthermore, Kittle rolled her eyes, shrugged her shoulders, and laughed out loud at the questions from attorney Demosthenese Lorandos, demonstrating once more that the "professionals" at the local Children's Advocacy Center act like spoiled children when testifying in front of jurors. In fact, it got so bad that Dr. Lorandos finally asked Kittle if the trial was "funny." If one wanted to see the combination of dishonesty, incompetence, and arrogance, then Holly Kittle was the Main Attraction.

As readers remember, Kittle, who was an anthropology major at my alma mater, the University of Tennessee, worked with the Georgia Bureau of Investigation's "mobile crime lab" before its operations were suspended. If the GBI lab "team" was as dishonest as what has been exposed in North Carolina, then I suspect that Kittle received a good education in learning how to cook results for prosecutors.

You see, Holly Kittle is a good soldier for prosecutors, and whatever the prosecutors want from Kittle, they get it. Furthermore, Kittle is one of those people who believes that the Prosecution Always Is Right, and that anything one can do to push the prosecution's case -- no matter how dishonest or flimsy it might be -- is to be doing the Lord's work.

In my conversation with Ione Sells, she told me that Kittle and the others "interviewers" at the CAC in Fort Oglethorpe were superior to Dr. William Bernet and Dr. Nancy Aldridge because the CAC people always testify for the prosecution. When I asked about Dr. Aldridge testify for the prosecution many more times than she had for the defense, Sells spat out, "Oh, she hasn't testified for the prosecution since 2007."

That is interesting, and while I have not spoken to Dr. Aldridge about Sells' comments, my sense is that prosecutors don't want Dr. Aldridge on the stand because she actually tells the truth, and no self-respecting Georgia prosecutor these days wants anything to do with truth. If Dr. Aldridge and Dr. Bernet won't lie on the stand or act like the CAC clowns, then prosecutors don't want them. Don't kid yourself, people; it has come to that.

So, Kittle actually believes herself to be morally and professionally superior to people who literally have "written the book" on child forensic interviewing. (Her good Facebook friends Chris A. Arnt and Len Gregor both called Dr. Aldridge and Dr. Bernet "whores," and Sells told me she agreed with that assessment. Thus, I would surmise that Kittle agrees with it, too.)

As I see it, Holly Kittle is to forensic interviewing what Michael West is to forensic dentistry and Steven Hayne is to forensic pathology. As Radley Balko has so eloquently put it, these men will tell prosecutors whatever they want to hear, no matter how dishonest or implausible their accounts, and Kittle, likewise, will tell prosecutors whatever they want to hear.

As for Kittle, there is more. (I'll cover a number of instances of her incompetence and downright dishonesty in my next post on her.) She runs a photography business and posts a number of pictures she has taken on the Internet. In looking through her photos (which, frankly, are not high-quality compared to the photographer who has taken photographs of my grandchildren), two things struck me.

First, she has a number of pictures taken at an adoption party. As one who has adopted three children, I can tell you the joy of the "got'cha day" and the realization that our family in a very small way has made a difference in the lives of children who faced a grim future otherwise.

However, as I looked at those pictures, I remembered that Kittle is the main CAC "expert" (Lord, what a misuse of THAT term) witness in the upcoming trial of James Combs. Mr. Combs and his wife adopted a girl from Russia and a girl from Romania (and they have two birth children), which means that they also had their "got'cha" days. Furthermore, Mr. Combs, who served in the U.S. Armed Forces for 24 years, in order to be able to adopt any children, had to go through a number of examinations by law enforcement agencies from local police to the FBI to Interpol. (I have been through the same procedures and am quite familiar with them.)

Kittle, who has no children of her own, is trying to destroy Mr. Combs and his family by wanting to convince a jury that Mr. Combs is a child molester. It's funny that there never were any issues like that in Mr. Combs' life -- none -- and then one day, working as a substitute teacher at Boynton School in Catoosa County, he sends two boys to the principal's office and suddenly, they claim he molested them. This does not pass any smell test, but since the stench at the CAC and the LMJC already is overwhelming, people like Kittle and Sells are incapable of smelling anything but their own stink, which they then attribute to others.

Second, as I looked farther down the list, I saw that Kittle had taken a picture of a naked newborn being weighed on a scale right after birth. Given what I know about how the LMJC lackeys work, had a picture like this been in possession of either Mr. Combs or Tonya Craft, Kittle and others like Tim Deal would have claimed that these people were possessing child pornography.

I kid you not. That is how these individuals work when they are trying to frame innocent people.

So, Kittle feels free to take pictures of children, but if someone she and her other prosecution prostitutes were targeting someone for false charges had the same pictures in their possession, Kittle, Deal and others were make the "child pornography" accusations and present the photos as "proof" that they were dealing with a child molester.

Don't forget that Kittle works closely with people who have suborned perjury, committed perjury, forged documents, lied to jurors, hidden exculpatory evidence, and have proven themselves to be utterly dishonest and incompetent in dealing with the issue of child molestation. And this is the CAC prosecution "expert" who will be on the stand in the James Combs trial, trying to convince jurors that this family man and a person who has served his country honorably should go to prison for what clearly are trumped-up charges.

Kittle advertises on the Christians in Business website. She also likes to have Bible versus on her own photography site. I would suggest that perhaps she include the Ninth Commandment next time.

(In my next post on Kittle, I will explain just how dishonest and incompetent Kittle was when she interviewed Sandra Lamb's daughter in the Tonya Craft case.)

Channel 9's Sorry Record of Ignoring Due Process

Of all the news operations covering the Tonya Craft case, WTVC, Channel 9, stood alone in its utter badness. In fact, the coverage was SO bad that Holly "Thumbs Up" Kittle has included this rogue PR operation for corrupt prosecutors as one of her "likes."

One of the reasons I despise Channel 9 so much is that when it comes to people accused of child molestation, there NEVER even is the possibility of a false claim. Furthermore, there is no presumption of innocence at 9, just guilt, guilt, guilt. Its February 19, 2010, coverage of the arrest of James Combs is especially bad, although nothing will sink to the low level that 9 achieved with Tonya Craft, even after the trial was over.

I include the entire article, written by Karen Zatkulak, as from beginning to end, because it is just atrocious and guilt-assuming and shamefully so (my comments in bold):
A man is charged with child molestation while he's substitute teaching. We got the report that confirms the incident took place at an elementary school. (Yes, an accusation means that there definitely was molestation.) This report says James Combs was inside this school, teaching as a substitute, when 2 children say he touched them in a sexual manner.

Parents like Brianna Campbell are not just shocked but disturbed that a man trusted inside the classroom has now spent time inside jail. She says, "Surprising because they hire the teachers to teach not to hurt the kids." (Yes, after people are arrested, they usually are taken to jail. However, there is no "alleged" here. Channel 9 is spreading hysteria among parents, just as our vaunted news team did when it sent reporters to Tonya's neighborhood to scream, "CHILD MOLESTER!!!")

James Combs is charged with child molestation at Boynton Elementary School, leaving Campbell worried about her little ones. "It bothers me, but you still have to send your kids to school and hope and pray they come home okay."

We got the report from the Catoosa County Sheriff's Office. It says two children reported that Combs had touched them in a sexual manner. We wanted to know more about the young victims (How do we know they are victims? Again, Channel 9 assumes guilt.) and exactly when and how this happened, but were told Sheriff Phil Summers was the only one to answer those questions and was unavailable.

We also went to Combs' address to hear his side of the story, but no one was home. The school system did confirm that Combs was a substitute teacher when this happened.

Superintendent Denia Reese says, "James Combs completed the application process to be a substitute in our county, we did a GBI background check and FBI background check and they all came back clear." (Now, this is interesting. Here is a guy who never had been accused of any crimes before, who also passed an extensive investigation in order to be able to adopt two girls from overseas. Does not this raise questions to our Good People at Channel 9 about Mr. Combs' character, and that maybe, just maybe, these charges are fishy?)

Reese says immediately after they received the parent's complaint, they called the Sheriff's Office. "Mr. Combs was then immediately removed from the substitute list."

Campbell is glad that Combs is facing charges, but says she's still worried about the other students and the victims. "You are putting your kids lives and trust in the school system and when they break that trust it's hard to get back." (Why does Campbell get to be an accuser here? Do you think that Campbell would like to be falsely accused? Why does Channel 9 take her for an expert?)

While 2 children reported the misconduct, this report says Combs faces one count of child molestation.

We will be working to get more information, and will pass it on as soon as it's available.
In reading this story, I am utterly amazed at the outright evil that it represents. According to Darrell Patterson's employer, an accusation is proof of guilt, period, especially if it involves child molestation.

Having taught at Rossville Junior High School for a couple years, I have experience with some of the people from that area, and I can say that there were some students who (along with their parents -- and especially their mothers) would be anxious to make a false charge against a teacher. In fact, the only reason that we did not see any of these charges get momentum was that the LMJC had not yet discovered the riches that could be mined from Mondale Act money.

Notice that Channel 9 really made no effort to find out what happened. It just ran the official PR from the LMJC, interviewed a guilt-assuming parent of another child, and then presented it as "news."

I will say up front that I am convinced that James Combs is innocent of these charges, and that this is yet another perjury-filled action from Perjury Central itself, the LMJC. Since the LMJC and Channel 9 are at war with innocent and good people, I will officially say that I am at war with them. They can try to destroy innocent people -- and generally are successful at it -- but I will fight for James Combs and his family just as I fought for Tonya Craft. From everything I can tell, he is a good and decent man, and if Buzz Franklin, "judge" Brian Outhouse, and Alan "Wannabe a Criminal Like Facebook and The Man" Norton are going to try to railroad him into prison, I hope that the good people of the community will show that this is evil.

What is going on in the LMJC is not right. It is illegal and immoral. That Channel 9 continues to run PR for such corrupt people is proof enough to me that it no longer is a news operation. Instead, it consists of people who kiss the posteriors of corrupt liars, and then repeats the lies as "news."
